Terms of Use

1 – These Terms of Use set out the basis for use of the PA Noticeboard by You, as a registered user of the Site.  No other terms shall apply.

2 – By registering to use the PA Noticeboard, you confirm that You agree to comply with these Terms of Use.

3 – All rights to the PA Noticeboard are owned by Possability People (company number 05706441) (“Owner”) and the PA Noticeboard is made available through this Site

4 – In these Terms anything which You may post on the PA Noticeboard (or which may be posted on it on Your behalf) is referred to as “Your Content”.

5 – You agree that Your Content will be available to all registered users (except that only your preferred methods of contact details will be visible).

6 – Information which You obtain from the PA Noticeboard on other registered users must only be used for the purpose of finding a personal assistant or direct employer.

7 – You must not under any circumstances disclose details which You obtain from the PA Noticeboard to any other person.

8 – If you are using the PA Noticeboard as a direct employer with a view to finding a personal assistant (“PA”):

(a)  You accept that the PA Noticeboard is for information purposes to help PAs find work and to help employers find PAs more easily;

(b)  You accept that We do not make any recommendations in relation to PAs and that We have not vetted any applications by PAs on the PA Noticeboard;

(c)  You accept that You are under no obligation to employ any person listed on the PA Noticeboard as a prospective PA, and that You will have sole responsibility in relation to Your decision about employing a particular PA;

(d)  You agree to make your own checks (including Disclosure & Barring Service (DBS) checks (formerly CRB checks)) as appropriate;

(e)  You accept our advice that You should enter into an appropriate employment contract with Your PA;

(f)   You agree not to contact a PA’s referee(s) until You have made a firm job offer to that PA and they have given you permission to do so.

9 – The PA Noticeboard may not be used for any of the following purposes:

(a)  disseminating any unlawful, harassing, libellous, unlawfully discriminatory, abusive, threatening, harmful, vulgar, obscene, pornographic or otherwise objectionable material;

(b)  transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

(c)  gaining unauthorised access to other computer systems;

(d)  interfering with any other person’s use or enjoyment of the Site or application;

(e)  breaching any laws concerning the use of public telecommunications networks;

(f)   breaching any rights of any person or body;

(g)  interfering or disrupting networks, web sites, applications connected to the website or application; or

(h)  making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

10 – We will have the right to monitor use of the PA Noticeboard and to remove any material or posting on it if, in our opinion, such material may be in breach of these Terms of Use.  However, nothing in this Paragraph 10 shall make Us responsible for monitoring use of the PA Noticeboard or for anything posted on it in breach of these Terms of Use.

11 – Access to the PA Noticeboard or related applications may be occasionally restricted or interrupted to allow for repairs, maintenance or the introduction of new facilities or services. We will try to restore the availability of the PA Noticeboard as soon as reasonably practicable.

12 – You must not attempt to gain unauthorised access to any server, computer or database connected to the PA Noticeboard.

13 – We will not be responsible, or liable to You or to any third party, for any loss or damage incurred due to:

(a)  the content of anything posted by You or any other person on the PA Noticeboard;

(b)  incompatibility of the PA Noticeboard or any related application with Your equipment, software or telecommunications links or that of any third party;

(c)  viruses or other technologically harmful material which may infect the PA Noticeboard as a result of access to or use of it by any person other than Our employees and contractors; or

(e)  any other technical or other problems which are not directly caused by Us.

14 – As a convenience to You and to other visitors, the PA Noticeboard or related applications may include links to other web sites or material which are beyond our control. We will not be responsible for content accessed through any such links.

15 – Where the PA Noticeboard or a related application contains advertising or sponsorship materials, advertisers and sponsors are responsible for ensuring that any material provided for inclusion complies with relevant laws and codes, and does not breach the rights of any third party. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

16 – We give no warranty that any materials incorporated into the PA Noticeboard or a related application are appropriate or available for use in locations outside the United Kingdom. Accessing the PA Noticeboard or application from territories where its contents are illegal or unlawful is prohibited. Any person accessing the PA Noticeboard from a location outside the United Kingdom does so on their own initiative and is responsible for compliance with local laws.

17 – You and other visitors to the PA Noticeboard must bear all risks generally associated with the use of the Internet.

18 – The Privacy Policy and the Cookies Policy as published on the PA Noticeboard will apply to You and to all visitors and all use of the PA Noticeboard.

19 – The PA Noticeboard may be used to collect and store information about You which includes contact information. This information may be used to contact You by email.

20 – We may use Your IP address to administer and diagnose problems with the PA Noticeboard, and to gather broad demographic information.

21 – The PA Noticeboard has security measures in place to protect the loss, misuse and alteration of the information under our control. Where access is password-protected, it is incumbent on You not to divulge the password to anyone. We will never ask for a password in an unsolicited phone call or in an unsolicited email.

22 – Although We make all reasonable efforts to ensure security of personal information, by using the PA Noticeboard You accept that no data transmission can be guaranteed to be 100% secure over the Internet.

23 – You agree to Us holding and using personal data as stated.

24 – We may amend these Terms of Use from time to time: We will notify all users of any amendment in advance.

25 – These Terms of Use are governed by the laws of England.
